Daniel and the Law

Laws are a set of rules established by a society, typically to protect its members and ensure the orderly function of society. For, Daniel, however, laws serve as a deterrent in his career as a singer-songwriter and marrying Grace VanderWaal. As one can guess, he has been in trouble with the law on multiple occasions, racking up an incredible amount of charges and visits to jail.

As of April 2024, Daniel has been to jail a whopping number of 7 times, 4 for being a fugitive of justice – after time and time again of not attending court, 2 for assault, one of which being to his own mother, and 1 time for for making several terroristic threats against the government and other establishments. Daniel has found himself with charges for destruction of private property, petty theft, trespassing, criminal mischief, and so on. Despite this, Daniel has hardly faced any incarceration despite these crimes, and when he has, he has rarely ever stayed behind bars for very long, only receiving a slap on the wrist.

Colorado, where Daniel has resided for most of his life, has several laws meant to imprison repeat offenders – which often times means that if an individual is brought in a third time for a felony or misdemeanor, the sentence if found guilty is more severe than than the last (in some states, the sentence is life in prison). But, seeing as Daniel has almost always gotten away with a slap on the wrist, it is very unlikely that he'll be staying in jail, much less prison. Due to the negligence of the police, several businesses have been defrauded by Daniel.

However, as of 2024, Daniel may be put away for over 65 years due to the severity of his actions.

Understanding of the Law

As with his grip on reality, Daniel's understanding of the law is tenuous at least. Daniel legitimately beleives trolling is illegal, as well as regularly threatening unspecified legal actions against people who say mean things to him online, expose him for pedophilic behaviour, or employees who remove them from establishments.

Daniel himself is prone to making violent threats, such as threatening to kill Bob Proctor on several occasions, as well as threatening to blow up with White House[1] which are illegal in and of itselves. Daniel is also prone to calling the police for ridiculous. reasons, such as when he (albeit, allegedly) screamed that he had a bomb to a 911 operator after Music was rescued from him, as well as demanding police officers to "CALL FUCKING DISPATCH!" in response to him being trolled online.[citation needed]

Interestingly, Daniel seems to have a rather skewed view of the idea of "self-defense". During several fights with Bob or others, he is often the one to start altercations opposed to protecting himself whenever they happen.

Timeline

The following is a list of incidents Daniel has had with the law.

2017

On November 6th, 2017, Daniel was arrested for 3rd degree assault after getting into a physical altercation with his wheelchair bound mother, which ended up with him being sent to jail for 44-45 days. It is unknown what caused this situation, however, Daniel claims that it was aggravated after his mother allegedly cornered him, causing him to push her to the side. On this day, Daniel also received charges for instances of property damage and criminal mischief, although what happened to cause these charges is unknown and will most likely stay unknown.

2020

In 2020, Daniel was reported to the FBI following the leaking of his Pinterest account in November. His Pinterest account contained several saved pictures of children, as well as a map of the age of consent in the United States. Several TikTok users, most notably The Delegation Podcast, were under the assumption that Daniel was under the possession of illegal images of minors, which resulted in him being reported to the FBI as a result.[2] After being reported, this spark the first Dark Age, where Daniel left the internet for 3 1/2 months, coming back to TikTok in March of 2021.

While it is unclear what truly happened, and what the legal proceedings were, Daniel claimed on several occasions that he was investigated by FBI, and due to this, he was unable to show his face until further notice, and at a later date, claimed he was "cleared."

2021

Destruction of property

Daniel's court order for property destruction. (Featuring his dirty thumb!)

On August 13th, 2021, Daniel was charged with destruction of property for smashing the window of a car on someones private property.[3]

Due to this, Daniel was summoned to court. He failed to appear four separate times, and has had $350 worth of fees imposed on him via bond, bond forfeiture, and warrant fees. $100 worth of these has already been paid, leaving $250 due.[citation needed]

On August 29th, 2022, Daniel's destruction of property charge was dismissed. [4]

2022

Petty Theft

On May 13th, 2022, Daniel was charged with petty theft, based on the location of the violation: "500 16TH ST #120". It appears to be the location of a Hard Rock Café, suggesting it was a target of one of Daniel's dine and dashes.

Criminal Mischief

On June 9th, 2022, a criminal mischief case was opened against Daniel. After failing to appear once, the warrant was executed when he was arrested during his October 16th tantrum. Daniel was appointed a public defender on October 25th with his "plea and setting hearing" on November 28th.

Alleged warrant merge

On August 4th 2022, Daniel uploaded a video announcing that he had gotten all of his warrants all taken care of by "merging it all into one case", saying that it should all be cleared up within the month.[5][6] While its validity is unclear, it is most likely that his cases were merged into one individual case due to Daniel repeatedly not showing up for them when ordered to.

Destruction of Property

On October 16th, 2022, a new case was opened for Daniel for destruction of property. The details of this are unknown, and it is unclear as to what happened to cause this. Daniel failed to appear on December 20th, 2022, and several other times after that. Eventually, his warrant was canceled on June 21, 2023.[7]

2023

Trespassing

On May 15th, 2023, Daniel posted that overnight he was given a citation for sleeping in a MTA subway station. He said that it was a $100 fine, and posted a video that briefly shows the ticket on his TikTok account.[8]

Dine and Dashing

On January 19th, 2023, Daniel was arrested for attempting to dine and dash at a Cheesecake Factory in Anaheim, California. Daniel was charged with "defrauding an innkeeper" and received a $950 fine.

School of Mines Wall Damage

On July 11, 2023, Daniel livestreamed an interaction he had with EMTs after calling 911 multiple times. While he was in the ambulance a police officer was able to charge him $500 for damages to a wall at the School of Mines. Daniel quickly admitted to his crimes claiming he damaged the wall to make sure he was heard, that "this was serious".

Jefferson County Court Hearings

On September 14th, 2023, Daniel announced he would be appearing in court the following day in a YouTube short and several community posts. This was an arraignment for two misdemeanours at the Jefferson County Court in Golden, Colorado to which he turned up late. It is uncertain what exactly the charges were but he claimed that the maximum sentence was two years in jail. Daniel would plead not guilty, likely to buy him some time and hope for a good plea bargain. His next appearance in court would be set as October 31st, 2023, for a pre-trial conference.

After the arraignment, Daniel was again interviewed by Dylan. Daniel was asked several questions regarding Grace Vanderwaal, the trolls, leaked nudes and dating sites. In another video, Dylan also presented Daniel with some texts regarding Grace and Phi Kappa Tau. Daniel appeared troubled by these texts and proceeded to ask permission to take a photo of Dylan's phone. He soon after posted the image to YouTube through several community posts. There would later be a pre court interview uploaded by Dylan's friend, baristamuffin64.
